Summary:

The U.S. Supreme Court recently rendered its decision in consolidated cases among the City of Miami and large banks. In its 5-3 decision, the Court examined such issues as requirements for Standing, the ability to bring a cause of action based on an underlying claim, and Fair Lending principles. The Court examined whether the Fair Housing Act is broad enough to permit cities to sue banks for damages for undertaking large numbers of foreclosures within their boundaries.

The Court reached its conclusions analyzing:

  • Whether cities are within Fair Housing Act protected "Zones of Interest";
  • Whether and how cities may fall within the definition of "Aggrieved Parties";
  • What factors must be present for cities to meet the "Proximate Cause" requirement; and
  • Whether cities must establish a "Direct Relation" between the injury that is the basis of their claim, and the conduct that allegedly caused it.
