The "Know Before You Owe/TRID" mortgage disclosure rule, which became effective on October 3, 2015, was designed to reduce the number of disclosures required for a mortgage transaction. However, the vast rule left certain processes unclear and numerous questions unanswered, including an area known as the "Black Hole." On April 26, 2018, the BCFP (aka: CFPB) finalized an amendment to its "Know Before You Owe/TRID" mortgage disclosure rule that addresses when mortgage lenders with a valid justification may pass on increased closing costs to consumers when disclosing them on a Closing Disclosure. The amendment is intended to remove the timing restriction on when a creditor may use a Closing Disclosure to communicate closing cost increases to the consumer, otherwise known as the "Black Hole." There are some important things to know about this update to the rule.
